Showcase IDX Terms and Conditions

The following PSTs shall apply to any Product identified in an Order Form as "Showcase IDX" ("Showcase IDX")

  1. Termination: Except as specified in the GTCs and in these PSTs with respect to the Showcase IDX Products, Customer may not terminate the Agreement prior to the expiration of the Initial Term or any Renewal Terms. Customer may terminate the Agreement with respect to the Showcase IDX  Products at the end of the Initial Term or any Renewal Term by providing at least 35 days advance written notice prior to the end of the Initial Term or Renewal Term, as applicable. To provide such notice of termination to Supplier, Customer must sign and return the cancellation confirmation form provided by Supplier on or before the date specified therein. To obtain the cancellation confirmation form and provide notice of termination, Customer shall email: help@showcaseidx.com .  Once terminated, Supplier may permanently delete Customer's account and all the data associated with such account, except as otherwise stated in this Agreement.

  2. Eligibility. In order to be eligible to use Showcase IDX, Customer must (i) be an actively licensed real estate agent with its local real estate board and MLS; (ii) for each of the MLSs Customer desires to display on its website, complete the registration process with Showcase IDX and where necessary, the MLS; (iii) agree to the terms outlined in this Agreement; and (iv) provide accurate, complete, and up-to-date contact information to Supplier. By using Showcase IDX, Customer represents and warrants that it meets all the requirements listed above, and that Customer will not use Showcase IDX in a way that violates any laws, regulations or MLS rules.

  3. Authority. If Customer signs up for Showcase IDX on behalf of a specific real estate agent, Customer or other entity, Customer represents and warrants that Customer has the authority to accept this Agreement on behalf of such agent and their corresponding responsibilities on their behalf.

  4. MLS Permissions and Terminations. Customer represents and warrants that Customer has permission and will continue to have permission to access the MLS IDX listing data contained within Showcase IDX as required by each applicable MLS. In the event Customer is no longer a member of one or more MLSs from which it accesses data within Showcase IDX, Customer shall inform Supplier of such termination of membership as soon as practicable and in no event more than two (2) business days.  Supplier may terminate Customer's access to any particular MLS feed in the event it learns or has reason to believe Customer does not have permission to access such MLS feed. Further, Supplier reserves the right to refuse service, close accounts of any users, and change customer eligibility requirements at any time and for any reason.

  5. Data Access Fees. Supplier charges (i) "MLS Pass-Through Fees," which are fees charged by an MLS on Supplier in for each data feed and are passed through to customers who use those feeds, and (ii) a Data Management Fee in respect of the provision of normalized and standardized access to such MLS Data by Supplier and/or its Affiliates and Licensors. Customer will see these fees as line item on the billing summary before subscribing to a plan.

  6. Compliance. IDX software, like Showcase IDX, must abide by MLS rules and regulations, which are set by NAR (National Association of Realtors) and the applicable MLS. This may include identifying the listing agents or offices on each listing, displaying required logos and disclaimers, and what listing information can or can't be displayed on a website.  Each website may also be required to maintain its own branding in compliance with the MLS rules and regulations. Notwithstanding the foregoing, Supplier hereby disclaims all liability for Customer's compliance with applicable MLS, NAR and other professional obligations placed on Customer.

  7. Showcase IDX Privacy Policy. Notwithstanding anything in the GTCs, Supplier's Privacy Policy as it relates to the Products governed by these PSTs is located at https://showcaseidx.com/privacy-policy/. Additional data privacy and security terms are located at https://showcaseidx.com/dpa/.
